INDUSTRIAL DESIGN

Article 1.2 of Law 20/2003 states that shall mean:

A) Design: The appearance of the whole or part of a product resulting from the features of, in particular, the lines, contours, colors, shape, texture or materials of the product itself or its ornamentation.

B) Product: Any industrial or handicraft item, including  the parts intended to be assembled into a complex product, packaging, presentation, graphic symbols and typographic typefaces, but excluding computer programs.

C) Complex product: A product consisting of multiple components which can be replaced permitting disassembly and reassembly of the product. 

A registration may comprise several designs, up to 50, where they relate to products belonging to the same class of the International Classification of Industrial Designs established by the Locarno. The latter limitation shall not apply in the case of two-dimensional ornamentation.

The multiple application shall include a representative of each of the designs, with indication of the products to which they apply.

The Article 182 of the Industrial Property Statute provides: "The term Industrial Design names any object that could serve as a pattern for making a product that can be described by its structure, configuration, ornamentation or representation. " That is, protects only the form .

Will be considered as a single Industrial Design, that which is composed of different parts, whether it needs to make a whole. (For example the game of chess, or dishes).

It will be allowed to be requested in a single file from one to fifty Industrial Designs, as long as they have the same application, even though they are different. (For example, tables or pictures). In this case, it will have a single registration number.

Rights // Obligations

----Right to prohibit others to design a similar industrial reproduction.

----Ability to prevent the granting of the same or similar industrial designs.

----Obligation to pay the Registry and the first payment of taxes for five years.

----Obligation to reproduce industrially the model or drawing.

Your protection is available at national, international and community level.

NATIONAL INDUSTRIAL DESIGN

-Duration:

Five years from the date of application of your design, being able to extend the exclusivity rights for a further period of 5 years each time, so that the rights on an Industrial Design can hold for a period of 25 years.

Our “Deadline and Surveillance Department” is responsible for notifying the renovations and monitor your records, and if necessary our Legal Department will present opposition to any request for an Industrial Design similar to yours.
